sample clearances

enigma music management, will review all audio for existing sound recordings (“samples”) that require additional clearance, provide detail reporting + the extent of clearances. enigma’s longstanding relationships with record labels + music publishers, ensures swift responses to meet demanding deadlines.
samples:

a music sample contains two separate copyrighted works. one is the original sound recording controlled by the record label + the other is the underlying musical composition controlled by publisher(s).
a sample can be a guitar sound, drum sound, piano sound, vocals, etc. lifted from an existing sound recording. whether you replay or use a portion of the original sound recording it requires a publishing or master-use license.
enigma will negotiate + secure licenses with record labels + publishers providing fully executed licenses + publishing splits for your “new sound recording” (i.e., new derivative work).

there are two stages to clearing a sample:

if the existing sound recording that you are sampling contains a sample, you are required to clear all existing sound recordings.
the rights granted typically give you the ability to sell your new sound recording with the embodied sample in all media.
however, the rights granted do not give you the right to license this new recording to third parties (such as film, television, video games etc.) without additional clearances + permissions.
covers:
covers do not require sample clearance, but a compulsory license granted by the copyright owners(s) (“publishers”).
a compulsory license allows you to arrange the song but you cannot change the melody or write new lyrics.
record labels + distributors will not release audio without the guarantee that all samples have been cleared (in other words, you are liable of any claims). intentional copyright infringement is a criminal offense.
